Terms of Service

These Terms of Service (“Terms”) constitute a binding agreement between Green Dot Lawn Care (“Green Dot,” “we,” “us,” or “our”) and you (“Client,” “you,” or “your”), including representatives for residential or commercial properties such as HOAs, apartments, schools, or businesses in Colorado Springs. By submitting payment information via our secure payment portal or using our services (lawn care, landscaping, yard cleanups), you agree to these Terms, our Privacy Policy , and Liability Waiver. If you do not agree, please do not use our services. These Terms are governed by Colorado law, with disputes resolved in Colorado Springs courts.

1. Services Provided

Green Dot provides the following eco-friendly services in Colorado Springs:

• Lawn Care: Mowing, precision metal edging for crisp lines between sidewalks/driveways and grass, trimming, leaf blowing, debris cleanup from driveways/patios/decks, and eco-friendly weed management (manual removal, no pesticides).
• Landscaping: Rockbed cleanouts, new landscape fabric, planting trees/bushes/flowers, landscape tear-downs (removing small trees, bushes, flowers), mulching, flowerbed mulching, tree ring creation, sod installation, and tree/shrub trimming.
• Yard Cleanups: Hand-picking weeds, cutting tall grass, trimming fence lines and home sides, pruning bushes/trees, and eco-friendly weed management.

Services are provided based on a free in-person estimate, with scope and pricing agreed upon prior to commencement.

2. Payment and Policy Agreement

After scheduling a free in-person estimate, we send an email with links to these Terms, the Privacy Policy , and Liability Waiver. You must add payment information via our secure payment portal, where card details are stored and used for payments unless you instruct otherwise. By adding your card or using our services, you agree to all three policies. If you do not agree, please do not use our services.

3. Additional Custom Work

Any custom work requested beyond the agreed scope during the in-person estimate will be billed at $150 per hour. We will inform you of additional costs and obtain your explicit approval before commencing such work.

4. Service Imperfections and Non-Liability

Lawn care, landscaping, and yard cleanup services may result in minor imperfections, such as small pieces of grass, weeds, or leaves not fully removed, which are inherent to these services. To the fullest extent permitted by law, Green Dot is not liable for any damage to property (e.g., windows, doors, sprinklers, pipes, wires, underground utilities), vehicles, or injuries to people or pets during service performance, including but not limited to damage from rocks or debris propelled by mowers or trimmers in grass or rock beds, unless ordered by a court of law. You expressly waive your right to sue Green Dot for such claims, as detailed in our Liability Waiver.

5. Client Responsibilities

To ensure safe and effective service delivery, you agree to:

• Remove all vehicles from the service site, driveway, and adjacent areas prior to service commencement. Green Dot is not liable for vehicle damage.
• Mark or disclose hidden hazards (e.g., sprinklers, pipes, wires, underground utilities, rocks in grass or rock beds). Green Dot is not responsible for damage to unmarked items.
• Ensure people and pets are kept away from the service area during operations. Green Dot is not liable for injuries.
• Provide accurate property information during the free in-person estimate to avoid scope changes.
• Clear the service area of obstacles (e.g., toys, furniture) to allow safe access for equipment.

Failure to comply does not impose liability on Green Dot.

6. Photo and Video Usage

By adding payment information via our secure payment portal or using our services, you grant Green Dot permission to take and use photos or videos of completed lawn care, landscaping, or yard cleanup work for marketing, social media, and promotional purposes. No personal identifying information will be included without your explicit consent.

7. Payment Terms

Payments are processed via our secure payment portal, with card information stored securely and used for payments unless you instruct otherwise. You agree to pay for services as outlined in the in-person estimate. Invoices are due upon receipt unless otherwise agreed. Late payments may incur a fee of 1.5% per month on the outstanding balance. Non-payment may result in service suspension or legal action.

8. Cancellation and Refunds

You may cancel services by contacting us at [email protected] or 719-249-1215 at least 24 hours before the scheduled service. Cancellations within 24 hours may incur a $50 fee. Refunds are issued at our discretion for prepaid services not rendered, less any applicable fees.

9. Indemnification

You agree to indemnify, defend, and hold harmless Green Dot, its owners, employees, contractors, and agents from any claims, losses, damages, liabilities, or expenses (including attorney’s fees) arising from your use of our services, violation of these Terms, or third-party claims related to your property, including those from HOAs, schools, or businesses.

10. Force Majeure

Green Dot is not liable for delays or failures in performance caused by events beyond our control, including weather conditions, natural disasters, or governmental restrictions, which may affect service delivery for residential or commercial clients.

11. Insurance

Green Dot maintains commercial and liability insurance. However, you are encouraged to maintain your own property insurance for additional protection, especially for commercial properties like schools or HOAs, as our liability is limited per the Liability Waiver.

12. Termination

We may terminate services for non-payment, violation of these Terms, or unsafe conditions (e.g., failure to remove vehicles or hazards). You will remain liable for any outstanding payments.

13. Severability

If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions remain in full force and effect.

14. Changes to These Terms

We may update these Terms, with changes posted on our website and a revised effective date. Continued use of our services constitutes acceptance of the updated Terms.
