Liability Waiver

Effective Date: June 3, 2025

This Liability Waiver (“Waiver”) is a legally binding agreement between you (“Client,” “you,” or “your”) and Green Dot Lawn Care (“Green Dot,” “we,” “us,” or “our”), a lawn care service provider based in Colorado Springs, Colorado, serving residential properties in Lorson Ranch, The Glen, Fountain, Security-Widefield, and proximate areas. By engaging with our services, you unconditionally agree to be bound by this Waiver, our Terms of Service, and any associated invoices or confirmations (collectively, the “Agreement”). If you do not consent, you must not utilize our services.

1. Acceptance of Waiver and Terms of Service

Upon reserving a service, you will receive a confirmation email containing this Waiver and our Terms of Service. Your failure to object in writing within twenty-four (24) hours constitutes full acceptance of the Agreement, pursuant to Colorado contract law (Restatement (Second) of Contracts § 69). 2. Scope of Services and Limitations

2.1 Authorized Services
Green Dot provides lawn care and exterior maintenance for residential properties under half an acre, including:

• Core services: mowing, edging, blowing ($35.95); weed removal ($50).
• Custom services: tree trimming, mulching, sod installation (quote-based).
• Seasonal packages: Early Spring ($295), Spring ($195), Fall ($295).
• Exterior maintenance: driveway sealing, power washing (quote-based).
• Winter services: snow removal ($75), Christmas lights ($999).

2.2 Unlicensed Services
We do not perform services requiring specialized certifications (e.g., plumbing, electrical, pesticide application). Such requests will be refused without liability.

2.3 Service Limitations
Services may leave residual debris, inherent to lawn care. You accept these limitations and waive claims for minor imperfections.

2.4 Client Preparation
You must remove debris, pet waste, and obstructions, secure pets, and provide access. Failure may result in delays, charges, or refusal of service without liability.

2.5 Scheduling and Cancellations
Appointments are time ranges. We may reschedule or cancel due to weather or other factors, with no liability. Payments are non-refundable.

2.6 Right to Suspend or Abandon Services
We may suspend services for unsafe conditions or equipment malfunctions, returning within 7 business days to complete paid services unless canceled. Payments are non-refundable.

2.7 Client Responsibility for Lawn Maintenance
You must perform ongoing maintenance (e.g., watering, pest control). We are not liable for lawn health issues due to your neglect.

2.8 Pre-Existing Conditions
We are not liable for pre-existing lawn issues (e.g., diseases, pests). You waive related claims.

2.9 Force Majeure
No liability for delays due to acts of God or uncontrollable events. Payments remain non-refundable.

2.10 Client Representations
You warrant authority to authorize services and property compliance with laws, indemnifying us for misrepresentations.

3. Zero Liability

3.1 Disclaimer of Liability
To the fullest extent permitted by Colorado law, Green Dot has no liability for damages, injuries, or losses, including property damage, personal injury, or lawn health issues.

3.2 Waiver of Right to Sue
You waive any right to sue Green Dot for any claims related to our services, including negligence.

3.3 Green Dot’s Right to Sue
We reserve the right to sue for non-payment or breaches, with you bearing all costs.

3.4 Assumption of Risk
You assume risks from environmental factors (e.g., weather, soil) affecting service outcomes.

3.5 No Warranties
Services are provided “as-is” with no warranties of results or lawn health.

4. Pricing and Payment Obligations

4.1 Pricing Structure
Fixed prices (e.g., $35.95 Basic Lawn Service) and quote-based pricing apply. No extra work is performed without a separate invoice.

4.2 Payment Terms
Payment is due within 30 days, with late fees ($50) and 5% monthly interest for overdue amounts.

4.3 Liens for Non-Payment
Non-payment after 60 days may result in a mechanic’s lien (C.R.S. § 38-22-101 et seq.), with you bearing all costs.

4.4 Legal Action for Non-Payment
We may sue for unpaid amounts, with you liable for all costs.

4.5 No Refunds
All payments are non-refundable, regardless of service status or satisfaction.

5. Termination and Refusal of Service

We may terminate or refuse service for non-payment, unsafe conditions, or abusive behavior, with you liable for outstanding amounts.

6. Indemnification

You indemnify Green Dot against claims arising from your use of our services, failure to comply, or third-party disputes (e.g., HOA fines).

7. Governing Law and Dispute Resolution

Governed by Colorado law, disputes are resolved in El Paso County courts, with you waiving jury trial rights.

8. Miscellaneous Provisions

8.1 Entire Agreement
This Waiver, Terms of Service, and invoices constitute the entire agreement, superseding prior agreements.

8.2 Severability
Invalid provisions are severed, with remaining terms enforceable.

8.3 Non-Reliance
You have not relied on external representations outside this Agreement.
