This waiver outlines the terms under which Green Dot Lawn Care provides services, ensuring clear expectations for our Colorado Springs clients, including homes, HOAs, apartments, schools, and businesses.

This Liability Waiver (“Waiver”) is entered into between Green Dot Lawn Care (“Green Dot,” “we,” “us,” or “our”) and you (“Client,” “you,” or “your”), including any representatives for residential or commercial properties such as HOAs, apartments, schools, or businesses in Colorado Springs. By submitting payment information via our secure payment portal, using our services (lawn care, landscaping, or yard cleanups), or receiving an estimate, you agree to this Waiver, our Terms of Service, and Privacy Policy. If you do not agree, please do not use our services. This Waiver is governed by Colorado law, and any disputes shall be resolved in El Paso County courts.
You acknowledge that lawn care, landscaping, and yard cleanup services involve inherent risks, including but not limited to equipment use (mowers, trimmers), environmental factors (rocks in grass, hidden objects), and minor imperfections (e.g., small pieces of grass, weeds, or leaves not fully removed). You assume all risks associated with these services, whether known or unknown, and agree that Green Dot is not responsible for any resulting issues.
To the fullest extent permitted by law, you release, waive, discharge, and hold harmless Green Dot Lawn Care, its owners, employees, contractors, and agents from any and all liability, claims, demands, actions, or causes of action for any loss, damage, injury, or death to persons (including you, family members, employees, students, or pets) or property (including windows, doors, sprinklers, pipes, wires, cars, vehicles, or other items), whether caused by negligence, accident, or otherwise, arising from or related to our services. This includes, but is not limited to:
You expressly waive your right to sue Green Dot for any such claims, except as ordered by a court of competent jurisdiction. This waiver applies to all services, including lawn care (mowing, edging, trimming, debris cleanup), landscaping (rockbed cleanouts, planting, mulching, tree rings, sod installation, tear-downs, tree/shrub trimming), and yard cleanups (weed-picking, grass cutting, fence line trimming, pruning).

Failure to comply does not impose liability on Green Dot.
Any custom work requested beyond the agreed scope during the in-person estimate will be billed at $150 per hour. Clients will be informed of additional costs prior to work commencement, and such work requires explicit approval. Refer to our Terms of Service for full details.
By adding payment information or using our services, you grant Green Dot permission to take and use photos or videos of completed work for marketing, social media, and promotional purposes. No personal identifying information will be included without your explicit consent.
You agree to indemnify, defend, and hold harmless Green Dot Lawn Care from any claims, losses, damages, liabilities, or expenses (including attorney's fees) arising from your use of our services, violation of this Waiver, or any third-party claims related to your property, including those from HOAs, schools, or businesses.
Green Dot maintains $1,000,000 in commercial and liability insurance for our operations. However, this Waiver limits our liability as stated, and you are encouraged to maintain your own property insurance for additional protection, especially for commercial properties like schools or HOAs.
Green Dot is not liable for delays or failures in performance caused by events beyond our control, including weather conditions, natural disasters, or governmental restrictions, which may affect service delivery for residential or commercial clients.
If any provision of this Waiver is held invalid or unenforceable by a court, the remaining provisions remain in full force and effect.
We may update this Waiver, with changes posted on our website and a revised effective date. Continued use of our services constitutes acceptance of the updated Waiver.
