Liability Waiver

This Liability Waiver (“Waiver”) constitutes a legally binding and irrevocable agreement between you (“Client,” “you,” or “your”) and Green Dot Lawn Care (“Green Dot,” “we,” “us,” or “our”), a lawn care service provider based in Colorado Springs, Colorado, serving residential properties in Lorson Ranch, The Glen, Fountain, Security-Widefield, and proximate areas. By engaging with our services, you unconditionally and irrevocably agree to be bound by this Waiver, our Terms of Service, and any associated invoices or confirmations (collectively, the “Agreement”), thereby fully accepting all inherent risks associated with lawn care, waiving your right to initiate any legal action against Green Dot for damages or injuries arising from ordinary negligence or inherent risks, and acknowledging that Green Dot shall bear no liability whatsoever for any damages, injuries, or losses of any kind arising from or related to the provision of our services, except in cases of gross negligence or willful misconduct as adjudicated by a court of competent jurisdiction. If you do not consent to these terms, you must refrain from utilizing our services.

1. Acceptance of Waiver and Terms of Service

Upon reserving a service, you will receive a confirmation email containing this Waiver and our Terms of Service. Your failure to object in writing within twenty-four (24) hours constitutes full and irrevocable acceptance of the Agreement, pursuant to Colorado contract law (Restatement (Second) of Contracts § 69). To reject, you must notify us in writing at [email protected] or by telephone at 719-249-1215 to cancel your service request. Continued engagement with our services, including any use thereof, signifies your absolute and binding consent to these terms, including the acceptance of all inherent risks, the waiver of your right to sue for damages or injuries arising from ordinary negligence or inherent risks, and the acknowledgment that Green Dot Lawn Care shall not be held liable for any consequences arising therefrom, except in cases of gross negligence or willful misconduct as determined by a court of competent jurisdiction.

2. Scope of Services and Limitations

2.1 Authorized Services
Green Dot provides lawn care and exterior maintenance for residential properties under half an acre, including:

• Core services: mowing, edging, blowing ($35.95); weed removal ($50).
• Custom services: tree trimming, mulching, sod installation (quote-based).
• Seasonal packages: Early Spring ($295), Spring ($195), Fall ($295).
• Exterior maintenance: driveway sealing, power washing (quote-based).
• Winter services: snow removal ($75), Christmas lights ($999).

2.2 Unlicensed Services
We do not perform services requiring specialized certifications (e.g., plumbing, electrical, pesticide application). Such requests will be refused without liability.

2.3 Service Limitations and Inherent Risks
Lawn care services, particularly in suburban environments with rock beds such as those prevalent in Lorson Ranch, The Glen, and nearby regions, inherently pose substantial risks of property damage or personal injury, including but not limited to shattered windows, arising from the presence of rocks, debris, or other environmental hazards. By engaging our services, you expressly recognize, acknowledge, and unconditionally accept these inherent risks as an inseparable and unavoidable component of lawn maintenance. You irrevocably waive all claims for any damages or injuries attributable to ordinary negligence or inherent risks, and you covenant that Green Dot Lawn Care shall be absolved of all liability for such occurrences, except where gross negligence or willful misconduct is conclusively established by a court of competent jurisdiction. Residual debris may persist following service, which you accept as a natural and inevitable consequence, further waiving any associated claims.

2.4 Client Preparation and Responsibility
You are solely and exclusively obligated to remove all debris, pet waste, rocks, and obstructions from the lawn, secure all pets, and ensure unobstructed access to the property prior to the commencement of our services. Any failure to fulfill these obligations may lead to delays, imposition of additional charges, or outright refusal of service, for which Green Dot Lawn Care shall incur no liability whatsoever.

2.5 Scheduling and Cancellations
Appointments are scheduled within designated time frames. Green Dot Lawn Care reserves the unilateral right to reschedule or cancel services due to inclement weather, equipment malfunctions, or other unforeseen circumstances, without assuming any liability. All payments rendered are non-refundable under any circumstances.

2.6 Right to Suspend or Abandon Services
We retain the absolute and unqualified right to suspend or abandon services at our sole discretion due to unsafe conditions, equipment failures, or any other reason, with an undertaking to resume and complete paid services within 7 business days unless cancellation is requested. All payments remain non-refundable in all instances.

2.7 Client Responsibility for Ongoing Lawn Maintenance
You bear sole responsibility for the ongoing maintenance of your lawn, including but not limited to watering and pest control measures. Green Dot Lawn Care shall not be held liable for any adverse lawn health conditions resulting from your neglect or failure to maintain the property.

2.8 Pre-Existing Conditions
Green Dot Lawn Care shall not be liable for any pre-existing conditions affecting the lawn, including but not limited to diseases or pest infestations. You irrevocably waive all claims pertaining to such pre-existing conditions.

2.9 Force Majeure
Green Dot Lawn Care shall bear no liability whatsoever for any delays or disruptions in service attributable to acts of God, natural disasters, or other events beyond our reasonable control. All payments shall remain non-refundable in such events.

2.10 Client Representations and Indemnification
You warrant that you possess full and unequivocal authority to authorize our services and that the property complies with all applicable laws and regulations. You agree to indemnify and hold Green Dot Lawn Care harmless from any and all claims, damages, liabilities, or losses arising from your misrepresentations, negligence, or failure to adhere to the provisions of this Agreement.

3. Comprehensive Zero Liability

3.1 Absolute Disclaimer of Liability
To the fullest extent permitted by the laws of the State of Colorado, Green Dot Lawn Care expressly disclaims all liability for any damages, injuries, or losses, including but not limited to property damage, personal injury, or adverse lawn health outcomes, arising from or in connection with our services, except where gross negligence or willful misconduct is conclusively established by a court of competent jurisdiction.

3.2 Irrevocable Waiver of Right to Sue
You hereby irrevocably waive any and all rights to initiate legal action or pursue claims against Green Dot Lawn Care for any matters related to our services, including but not limited to negligence, except in instances of gross negligence or willful misconduct as adjudicated by a court of competent jurisdiction.

3.3 Green Dot’s Right to Legal Recourse
Green Dot Lawn Care reserves the unqualified right to initiate legal proceedings against you for non-payment, breaches of this Agreement, or any other violations, with you bearing all associated costs, expenses, and legal fees incurred.

3.4 Assumption of All Risks
You expressly assume all risks associated with environmental factors, including but not limited to weather conditions, soil composition, and the presence of rocks or debris, which may impact the outcomes of our services, and you agree that such risks shall not impose any liability upon Green Dot Lawn Care.

3.5 No Warranties or Guarantees
All services provided by Green Dot Lawn Care are offered on an “as-is” basis, with no express or implied warranties or guarantees regarding results, lawn health, or any other outcome, and you waive any claims arising from such lack of warranties.

4. Pricing and Payment Obligations

4.1 Pricing Structure
Our pricing is structured with fixed rates (e.g., $35.95 for Basic Lawn Service) and quote-based pricing for custom work. No additional services will be rendered without a separate, mutually agreed-upon invoice.

4.2 Payment Terms
Payment is due within 30 days from the date of invoice issuance. Overdue amounts will be subject to a late fee of $50 and a monthly interest rate of 5% until fully paid.

4.3 Liens for Non-Payment
Failure to remit payment within 60 days may result in the filing of a mechanic’s lien in accordance with C.R.S. § 38-22-101 et seq., with all related costs to be borne by you, the client.

4.4 Legal Action for Non-Payment
Green Dot Lawn Care retains the right to pursue legal action to recover unpaid amounts, with you liable for all attendant legal costs, expenses, and fees.

4.5 No Refunds
All payments made to Green Dot Lawn Care are strictly non-refundable, regardless of the status of service delivery or your level of satisfaction.

5. Termination and Refusal of Service

Green Dot Lawn Care reserves the unilateral and absolute right to terminate or refuse service at our sole discretion for reasons including non-payment, unsafe conditions, or abusive behavior, with you remaining fully liable for any outstanding amounts owed.

6. Indemnification

You agree to fully indemnify, defend, and hold harmless Green Dot Lawn Care against any and all claims, liabilities, damages, or losses, including legal fees, arising from your use of our services, your failure to comply with this Agreement, or any disputes involving third parties, including but not limited to fines imposed by homeowner associations.

7. Governing Law and Dispute Resolution

This Agreement shall be governed exclusively by the laws of the State of Colorado. All disputes arising hereunder shall be resolved in the courts of El Paso County, and you irrevocably waive your right to a trial by jury in any such proceedings.

8. Miscellaneous Provisions

8.1 Entire Agreement
This Waiver, our Terms of Service, and any issued invoices constitute the entire and exclusive agreement between the parties, superseding all prior agreements, understandings, or representations, whether written, oral, or otherwise.

8.2 Severability
Should any provision of this Agreement be found invalid or unenforceable by a court of law, such provision shall be deemed severed, and the remaining terms shall remain in full force and effect, binding upon the parties without limitation.

8.3 Non-Reliance
You expressly acknowledge that you have not relied upon any representations, warranties, promises, or assurances outside the explicit terms of this Agreement in your decision to engage the services of Green Dot Lawn Care.
